Tax Compliance Certificate: when you'll be asked for one
A tax compliance certificate in Kenya, usually called a TCC, is KRA's confirmation that you have filed the returns you owe and paid, or arranged to pay, the tax that is due. It is one page, issued through iTax, and it opens doors: tenders, public jobs, some licences and many business deals simply will not proceed without one.
This article explains what a TCC really proves, who asks for it and why, how long one lasts, and the items on your KRA record that most often stop it from being issued.
What a tax compliance certificate in Kenya proves
A TCC says that, on the day it was issued, KRA considered you compliant. For an individual that mainly means your income tax returns are filed and there is no unpaid tax, penalty or interest on your ledger. For a business it also covers obligations such as VAT, PAYE for employees and withholding tax, depending on what the business is registered for.
It does not say how much you earn or how much tax you paid. It is a yes or no on compliance. That is why it is easy for others to rely on: anyone can confirm a certificate is genuine using the TCC checker on iTax, without seeing any of your financial details.
Because the certificate is issued by the system after checking your record, there is no interview in the normal case. If your record is clean, the certificate is usually issued quickly. If it is not, iTax tells you the application was declined, and the work is in finding and fixing the reason.
KRA can withdraw a certificate before it expires if it later finds something that changes your status, so a TCC is not a shield. It is a snapshot that stays valid only while you stay compliant.
Who will ask you for one
Government tenders are the most common reason businesses need a TCC. Public procurement rules require bidders to show they are tax compliant, and a missing or expired certificate is one of the quickest ways to be disqualified, however good the bid.
Individuals meet it most often through public jobs. Under Chapter Six of the Constitution, people shortlisted for public office are asked for clearance from several bodies, and KRA is always one of them. Our guide to Chapter Six clearance lists the others and how to time them.
For a public job, the TCC is often requested only after you are shortlisted, and the time allowed to provide it can be a week or two. That is enough if your record is clean and too little if you have several years of unfiled returns. People who expect to apply for public jobs do well to check their KRA status before they apply, not after the shortlist comes out.
Other places that ask include some county business licences, liquor licences, work permit applications, certain professional registrations and large private contracts. Banks sometimes ask for one for business loans. The common thread is trust: the person asking wants to know you are not carrying hidden tax trouble.
How long it lasts and when to renew
A TCC is valid for twelve months from the date of issue. Because tenders and job applications often come with short deadlines, waiting until you need one is risky. If something on your record needs fixing, that fix can take longer than the deadline allows.
KRA advises applying for a new certificate shortly before the old one expires. If you rely on a TCC for regular tenders, treat the renewal as a fixed yearly task, done after your annual return is filed, so the new certificate reflects the latest year.
Keep the certificate as a PDF in your own email and phone, not only on a flash disk. Tender documents and job portals usually want an upload, and having the file ready means you do not have to log in to iTax under deadline pressure.
Some organisations want a certificate issued within a recent period even if the old one is technically still valid. Read the requirements of each tender or advert carefully; if it says "valid", one within its twelve months is enough, but if it says "recent", get a fresh one.
What stops KRA from issuing it
The commonest blocker is an unfiled return. Every year with a missing return, including nil years, must be filed first. People who registered a PIN long ago and never filed are often surprised that KRA wants returns for years they had no income. Read what late KRA filing really costs to understand the penalties that come with catching up.
The second blocker is an unpaid balance: tax, penalties or interest. These must be paid, waived or covered by an agreed payment plan before a TCC is issued. A small penalty from years ago is enough to stop the certificate.
For businesses and people with income other than a salary, KRA also checks other obligations, such as monthly returns for VAT or turnover tax and compliance with electronic invoicing where it applies. An obligation that was registered but never filed counts against you even if the business was quiet.
Directors should know that some tender bodies also ask for the TCC of each director, not only the company. A director with unfiled personal returns can therefore cost the company a tender even when the company itself is fully compliant.
Employees with only a salary are rarely blocked by PAYE itself, since the employer remits it. What blocks them is the annual return: a missing year, or a nil return filed for a year when a P9 existed. Fixing that one return is often all it takes.
Finally, details must match. A PIN registered with a different spelling of your name, or a duplicate PIN on your ID, can hold things up. Fixing these before you apply saves a rejected application.
Common questions
How long is a TCC valid?
Twelve months from the date of issue, as long as you stay compliant. KRA can withdraw it earlier if it finds unfiled returns or unpaid tax.
Can I get a TCC with an unpaid penalty?
Usually not. The penalty must be paid, waived, or covered by a payment arrangement KRA accepts. Clearing it first is the quickest route.
How does an employer check my certificate?
Through the TCC checker on iTax or the KRA app. They enter the certificate number and see whether it is genuine and still valid.
Can someone else apply for my TCC?
The application is made from your iTax account, so whoever does it needs access to that account with your permission. The certificate is issued in your name and emailed to the address on your PIN.
Why was my TCC application declined?
Almost always an unfiled return, an unpaid balance, or an obligation registered on your PIN that has not been filed. Your iTax ledger and returns history show which one it is.
Do I need a TCC if I am only employed?
Only if someone asks for one, such as a public employer or a licensing body. Being employed does not create a need for a TCC on its own.
